imgwire.dev ("imgwire", "we", "us") is operated by Blackhawk Software, LLC.
By accessing or using imgwire, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the service.
1. Service Overview
imgwire provides image hosting, transformation, and delivery via APIs, SDKs, and CDN infrastructure.
2. Eligibility
You must be at least 13 years old to use imgwire.
3. Accounts and API Keys
You are responsible for:
- Maintaining the confidentiality and security of your account and API keys
- All activity that occurs under your account or using your credentials
You must promptly notify us of any unauthorized access or use.
You are solely responsible for any misuse of your API keys, including misuse resulting from failure to properly secure them or from enabling unsigned upload functionality.
4. Acceptable Use
You agree not to use imgwire to:
- Upload, store, or distribute illegal content, including child sexual abuse material (CSAM)
- Host or distribute malware or malicious code
- Use the service for non-image content or unrelated file hosting
- Abuse unsigned uploads or attempt to bypass service safeguards
4.1 Enforcement
We may, at our sole discretion and without prior notice:
- Rate limit or throttle requests
- Block API keys, IP addresses, or requests
- Remove or disable access to content
- Suspend or terminate accounts
These actions may be taken automatically or manually to protect the integrity, security, or performance of the service.
4.2 Fair Use
We may restrict or terminate usage that, in our judgment:
- Degrades platform performance
- Creates disproportionate infrastructure load
- Exploits system behavior or intended usage patterns
5. Content Ownership and License
You retain all ownership rights to content you upload.
By using imgwire, you grant us a worldwide, non-exclusive, royalty-free license to:
- Store, cache, and replicate your content
- Process, transform, and analyze your content
- Deliver your content via our infrastructure
We may use content in anonymized or aggregated form to improve the service.
6. Public Content
Content uploaded to imgwire is publicly accessible via CDN URLs by default.
You are responsible for ensuring that you do not upload sensitive, confidential, or private information.
7. AI and Processing
imgwire may process your content using automated systems, including image transformations and AI-based features such as moderation, detection, or editing.
7.1 Beta Features
Certain features may be designated as "beta" or "preview." These features:
- Are provided on an "as is" basis
- May be incomplete, unstable, or subject to change
- May be modified or discontinued at any time
Use of beta features is at your own risk.
8. Billing and Payments
Billing is handled through Stripe.
By subscribing to a paid plan, you agree that:
- Subscriptions renew automatically unless canceled
- You are responsible for all applicable fees
- All payments are non-refundable except at our sole discretion
9. Usage Limits
Your use of the service may be subject to limits, including storage, bandwidth, and transformation usage.
Exceeding these limits may result in throttling, restricted access, or degraded performance until limits reset or you upgrade your plan.
10. Data Deletion
Deleted content is removed from our systems within a reasonable period (typically minutes), although cached versions may persist temporarily.
Upon account closure:
- All user content is deleted
- Billing and invoice records may be retained for legal and accounting purposes
11. Copyright and DMCA
If you believe content hosted on imgwire infringes your copyright, you may submit a notice to:

We will review and respond in accordance with applicable law.
12. Termination
We may suspend or terminate access to the service at any time for violations of these Terms or for abusive or harmful use.
13. Service Availability
The service is provided on a best-effort basis. We do not guarantee uptime, availability, or performance.
We may modify, suspend, or discontinue any part of the service at any time without liability.
14. Disclaimer of Warranties
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied.
15. Limitation of Liability
To the maximum extent permitted by law, Blackhawk Software, LLC shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, revenue, or profits.
Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
16. Indemnification
You agree to defend, indemnify, and hold harmless Blackhawk Software, LLC and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the service
- Your content
- Your violation of these Terms
- Your violation of applicable law or third-party rights
17. Export Controls and Sanctions
You may not use the service if you are located in, or a resident of, any jurisdiction subject to U.S. embargoes, or if you are listed on any U.S. government restricted party list.
You agree to comply with all applicable export control and sanctions laws.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
19. Dispute Resolution
Any dispute arising out of or relating to these Terms or the service will be resolved through binding arbitration, except where prohibited by law or where claims may be brought in small claims court.
You agree to resolve disputes on an individual basis and waive any right to participate in class, consolidated, or representative actions.
20. Changes to Terms
We may update these Terms from time to time. Continued use of the service constitutes acceptance of the updated Terms.
